Success: Exxon Must Release Records in Climate Fraud Case

Target: Eric Schneiderman, Attorney General, New York

Goal: Applaud progress in case to prove Exxon knowingly withheld information regarding contribution of carbon emissions to climate change.

ExxonMobil must provide documents which may provide evidence the company withheld information regarding the growing threat of climate change from the public for decades, thanks to a recent ruling by an appeals court.

Exxon has been under investigation by New York and Massachusetts since the release of company memos indicating scientists were pressured to suppress their belief in a connection between increased carbon emissions and rising global temperatures. The effort dates back at least to 1978, when company scientists warned of a 10-year window for changing energy sources to avoid catastrophic effects on the climate. This concern was echoed by an Exxon subsidiary in 1980, stating in an internal report that “there is no doubt” increased fossil fuel usage is linked to rising carbon dioxide levels in the atmosphere. Meanwhile, the company has worked aggressively to sow doubt regarding that connection by providing over $30 million in funding to climate denial organizations, publishing full page denial ads in the New York Times, and successfully lobbying the Bush administration for removal of prominent climate scientists from government posts.

The judgement against Exxon represents a critical win for the public trust. It may arm state prosecutors with powerful evidence and sends a message that corporations cannot always spend their way out of accountability.
