Success: Live Entertainment Monopoly Busted by Jury of the People

Consumers have frequently had their hopes of attending a dream concert or other event dashed by exorbitant ticket prices. People who are lucky enough to have these experiences complain of budget-busting payouts as well. As detailed in this ForceChange petition, blame for the sky-high prices has often been directed at venue operator and concert promoter Live Nation, along with its acquisition Ticketmaster. Now, the companies are facing the legal music for what critics call a crippling monopoly over the live entertainment market.

Recently, 34 states brought a lawsuit against the conglomerate for alleged violations of antitrust law. The lawsuit argued that the companies took a multi-pronged approach to monopolize the industry. First, Live Nation Entertainment got ownership over three-quarters of large U.S. amphitheaters. Then, artists would be pressured to use these amphitheaters or else forsake Live Nation’s vast promotional network. Venue operators around the country faced the same intimidation and pressures. The monopoly inevitably drove up ticket prices, and consumers had little recourses for alternative purchase routes because Ticketmaster controls ticketing for at least 86 percent of big concert arenas. A jury of twelve apparently agreed with the case laid out, as they found Live Nation and Ticketmaster did commit antitrust violations. The financial liability for this case could run in the hundreds of millions of dollars. This case boosts an earlier settlement in an antitrust case brought forth by the Department of Justice. That settlement will include actions such as a cap in service fees, some divestment by Live Nation, and increased competition via a diversification in Ticketmaster alternative options…all of which should prove beneficial for ticket buyers.
