Max Penalty for Man Accused of Abducting, Choking and Throwing Flamingo to Floor

Target: Steven B. Wolfson, District Attorney, Clark County, Nevada

Goal: Seek the maximum lawful sentence for the man convicted of animal cruelty after taking and injuring Peachy the flamingo.

Peachy, a flamingo living at the Flamingo Las Vegas resort, was taken from his wildlife habitat and carried into a hotel room. Surveillance footage, photographs, and Snapchat recordings presented at trial showed Mitchell Fairbarn grabbing the bird by the neck, smiling, and laughing during the incident.

On October 19, 2026, a jury convicted Fairbarn of one felony count and one misdemeanor count of animal cruelty. Prosecutors focused the two charges on his treatment of Peachy inside the habitat and after taking the bird into the hotel. Fairbarn is now awaiting sentencing, scheduled for December 1, 2026.

The evidence described a frightened bird subjected to painful handling. Prosecutors said Peachy suffered pain when pulled by his feet, and feathers were found on the hotel room floor. Although Peachy has recovered physically, his veterinarian reported increased anxiety during examinations.

A conviction must now be followed by meaningful consequences. Captive animals depend on people for protection, and their suffering should never be dismissed as entertainment or a drunken prank. Sign this petition to urge District Attorney Steven B. Wolfson to seek the maximum lawful sentence for Fairbarn’s animal-cruelty convictions.

PETITION LETTER:

Dear District Attorney Wolfson,

A jury has convicted Mitchell Fairbarn of felony and misdemeanor animal cruelty following his removal and mistreatment of Peachy, a flamingo at the Flamingo Las Vegas resort. With sentencing scheduled for December 1, 2026, we urge your office to request the maximum penalty permitted for these convictions.

Please ensure that your sentencing recommendation fully addresses the trial evidence, Peachy’s physical suffering, and the veterinarian’s account of his increased anxiety following the incident. The court should hear a clear account of the harm caused to this vulnerable animal.

Intoxication and claims of a prank should not diminish accountability for cruelty. Please seek the maximum lawful term of incarceration and all other applicable penalties, and urge the court to impose a sentence that reflects the seriousness of these offenses.

Sincerely,
