Goal: Demand justice for pregnant woman who was forcibly sedated and had her child removed from her body without consent
An Italian woman travelled to Britain in 2012 to attend a training course at Essex’s Stansted Airport. She suffered a panic attack over her inability to find some passports and called police who – after discovering she had a pre-existing mental condition – took her to a psychiatric facility where she was restrained and prevented from returning to her hotel. During her non-consensual stay at the psychiatric facility, she was kept completely in the dark about the legal proceedings surrounding her pregnancy.
Social services then obtained a High Court order against the woman, allowing her to be forcibly sedated and her child removed from her womb. The council claims that it was acting in the child’s best interest, having decided that the woman was unfit to care for her baby after her mental breakdown. No one bothered to notify the woman’s family or Italian officials about the incident beforehand. The baby, now fifteen months old, remains in the care of social services and has still not been returned to the mother even though she has made a full recovery. The mother was escorted back to Italy by court order.
The victim’s lawyers claim that “even if the council had been acting in the woman’s best interests, officials should have consulted her family beforehand and also involved Italian social services, who would be better-placed to look after the child.” Brendan Fleming, the woman’s British lawyer, said he had “never heard of anything like this in [his] forty years in the job.” John Hemming, a British Liberal Democrat MP said that, “I have seen a number of cases of abuses of people’s rights in the family courts, but this has to be one of the more extreme.”
This is an absurd and shocking abuse of authority on the part of British officials. There are no excuses for this type of utter assault and exploitation of the mentally ill. This woman was brutally violated by an overly powerful and abusive government, without so much as a notice sent to those who love her.
Please sign this petition to demand that those responsible for this brutality are brought to justice and the awful system that allowed this to happen is entirely reformed.
Dear Mr Justice Mostyn,
Your ruling in the case of a mentally ill mother who has had her unborn daughter snatched right out of her womb by shockingly invasive state procedure is unusually cruel and unusual.
The proceedings of this case have read like a horror story; like a nightmare. The actions of the court and British social services have been reminiscent of the gross mistreatment of the mentally ill in centuries past, and do not bear any resemblance to a modern civilized society.
Reverse your ruling and do everything you can to work towards justice for this poor mother, separated by cruelty and misunderstanding from her baby after being brutally violated by the state. A civilized state does not treat the vulnerable in such a cruel and horrific manner.
