Target: Santa Clara County Superior Court Judge Phillip Pennypacker
Goal: Condemn Juge Pennypacker for letting a serial child rapist walk out of the courtroom with just three years of probation time
In a recent court case, Santa Clara County Superior Court Judge Phillip Pennypacker declared that a 20-year-old male deserved one year jail time and three years probation for his offenses. His crimes? Thirteen counts of sexual assault against minors. Defendant David Bates has already served one year in prison waiting for the trial, so despite the fact that the defendant David Bates sexually forced himself upon children repeatedly, he will be able to walk away with just probation time as his punishment. Sign this petition and tell Judge Pennypacker that these damaging assaults deserve more than just a slap on the wrist. Rape and assault are never okay, especially when children are involved.
In the summer of 2011, Bates graduated from California high school Los Gatos. The following summer, as a 19-year-old, he returned to Los Gatos and started to stake out his victims. Bates focused particularly on the school’s cheerleading team, and would often watch them practice. He then proceeded to assault at least four girls in a three month period. They ranged in age from 13 to 15-years-old. Not only is this illegal because the girls are not even old enough to give consent, but also because the victims stated that any sexual advance from him was unwanted. One of the girls, age 13, has even been checked into a program because of the intense psychological suffering she has experience since her attack.
Despite the evidence and the fact that Bates did not contest the charges against him, the Judge released him with a simple three years of probation. That means Bates is free to roam the streets, although he is not allowed to go near Los Gatos. This has been mandated partly because the Judge ruled that he stay away, but it is also because the school took out a restraining order against Bates when they noticed he was eyeing up two more girls right before he was arrested.
Bates sexually assaulted at least four girls and was charged with thirteen accounts of assault. Despite the fact that this clearly indicates he has the tendencies of a serial rapist, California Judge Phillip Pennypacker considered the one year Bates served in jail plus three years of probation as a fitting punishment for justice. In actuality, a rapist does not deserve to walk out of that courtroom. A rapist deserves jail time so they cannot hurt anyone else and maybe even find the necessary help to change. Sexual assault should never be taken lightly, and particularly in the case of children. Dear Judge Pennypacker,
I recently heard about the ruling you made in the case of the sexual assaults committed by David Bates. You ordered that his one year of jail time served until his court date was sufficient, and that he could leave with three years of probation. It seems hard to believe three years of probation and one year of jail time is sufficient for 13 sexual assaults committed by an adult. It is especially difficult when considering his victims were still children.
Sexual assault or rape is never okay and is a very serious offense. It is highly damaging to the victims and has lifelong effects. By releasing Bates on probation, he has the ability to assault children once more. And given that he assaulted at least four girls in a three year period seems to indicate this is a pattern for him.
Bates clearly needs help; his victims need justice; and the residents of California deserve to know they and their children are safer because of the court system. A ruling that takes rape lightly is never a wise or fair decision.
