Applaud Attorney Duo for Fighting Gay Marriage Bans

Goal: Commend participation in marriage equality case to bring attention to Virginia’s ban

Ted Olson and David Boies, the lawyer dream team that brought you the Supreme Court decision on Proposition 8, California’s anti-gay marriage ballot initiative, recently announced they would be joining a challenge to Virginia’s gay marriage ban. Since the ruling on Prop 8, which left the matter up to individual states, many cases like this one have been filed in various courts in 18 different states in an attempt to seize the moment. Olson and Boies, a conservative and a liberal, respectively, called the 2006 Virginia law banning gay marriage “draconian,” according to The Washington Post. Olson called his home state an “attractive target” because of its blatant denial of rights, saying, “The more unfairly people are being treated, the more obvious it is that it’s unconstitutional.”

The participation of Olson and Boies in this case will garner significantly more attention for the case to strike down the ban, which was approved by Virginia voters 57 percent to 43 percent. The plaintiffs in this case are two brave couples, California natives and mothers to a 15 year old Carol Schall and Mary Townley whose marriage is not recognized by Virginia, as well as Norfolk natives Timothy Bostic and Tony London, whose application for a marriage license was denied. The duo brings not only their renown, but also the record of their prior win in California. Olson says the Prop 8 success is “a great foundation for us which we can convey into the federal courts in Virginia.” Furthermore, the 5-4 ruling against the Defense of Marriage Act gives them ample material for the upcoming case: Justice Anthony M. Kennedy wrote in his majority opinion that “DOMA instructs all federal officials, and indeed all persons with whom same-sex couples interact, including their own children, that their marriage is less worthy than the marriages of others.” This destructive message cannot continue to be broadcast to Americans.

Thank you for providing a voice of hope to same-sex couples who only want equal access to the rights that heterosexual couples have always enjoyed by virtue of being in a heterosexual relationship. Thank you for continuing to pursue marriage equality across the United States. So many believe fervently in the work that you do everyday by making yourselves a dedicated part of this positive movement in American history.
