Goal: Commend the decision to uphold Los Angeles’ on-set condom requirement for adult films as constitutional
The porn industry recently attempted to challenge Los Angeles’ law requiring adult film performers to wear condoms, claiming that the requirement is unconstitutional. However, a federal judge ruled against the porn industry, upholding the condom requirement as constitutional.
The Los Angeles County Safer Sex in the Adult Film Industry Act was sponsored by five individuals affiliated with the nonprofit group, the AIDS Healthcare Foundation. Though the law was passed in November 2012, multiple adult film production studios and performers sued the count in early 2013 to prevent implementation of the law.
In the recent ruling, U.S. District Judge Dean Pregerson wrote that the AIDS Healthcare Foundation had presented sufficient evidence of the health risks targeted by the condom measure. The law attempts to alleviate those harmed by such health risks. While the adult film industry attempted to prove that frequent and universal STD testing makes condoms unnecessary, the plaintiffs failed to present any evidence from individuals in public health or medical positions.
This measure is a hugely important policy for sexual health. The law takes direct and material measures toward safeguarding the health and safety of adult performers in the porn industry.
