Applaud Attorney General for Relaxing Marijuana Regulatory Enforcement

Goal: Applaud Eric Holder for loosening marijuana regulatory enforcement.

Although marijuana has been legalized in a handful of states, the debate between determining the precedence of state or federal law remains an issue of contention. This has made state-regulated medical marijuana dispensaries uneasy because a handful of these businesses have become targets of arbitrary FBI stings.

However, Attorney General Eric Holder has announced a major liberalizing shift in policy, which provided clarification for conflicting laws. Federal prosecutors will now allocate their resources in taking down cartels, criminal enterprises, those who sell drugs to minors, and prevent trafficking of marijuana to states where it is still ban. Prosecutors will no longer go after casual marijuana users. Holder has also informed the governors of Washington and Colorado that he will respect states’ rights by upholding their recent legalization of recreational marijuana use. He will assist state governments in streamlining new regulations that fall in line with these new federal priorities.

This announcement comes after Holder’s recent descent against mandatory minimums for low-risk drug offenders. These recent Department of Justice policy shifts are a significant departure from draconian laws and towards a more progressive approach. Although marijuana is still illegal under the Controlled Substance Act,  it is a welcomed deescalation of the dysfunctional war on drugs. It is a beginning for a potential balanced co-existence between federal and state laws.

Dear Mr. Holder,

Thank you for relaxing the Department of Justice agenda towards the regulation of marijuana. Your opposition to mandatory minimums for low-risk drug offenders and sensible marijuana regulation are both worthy of praise. Both policies will help alleviate overcrowded prisons and will allow the reallocation of scarce federal dollars to deficient sectors of government. This is the correct path towards a more just criminal justice system.

State governments, medical dispensary businesses, and medical marijuana recipients will be more at ease with this new outlining of Department of Justice priorities on the regulation of marijuana. It will provide a template for state governments in legislating new regulations  that will satisfy federal mandates. The taxation of marijuana will also provide a new source of revenue for federal and state coffers.

Please continue your efforts in the decriminalization of marijuana.
