Goal: Applaud Attorney General Gary King’s fight for marriage equality in New Mexico
New Mexico Attorney General Gary King recently announced that banning same-sex marriages in New Mexico is unconstitutional, refusing to argue against gay marriage in a court of law. While he previously declined to give an opinion on the issue because of pending lawsuits, King is now pushing to invalidate the state ban on gay marriage. King’s announcement marks a step towards social equity for the LGBT community and should be emulated by other state attorney generals.
Announcing his rationale for defending gay rights, King asserts that New Mexico guarantees equal protection to all of its citizens, so same-sex couples should receive the same marital benefits that other heterosexual couples in New Mexico enjoy. The state constitution promises equal treatment of citizens desiring legal marital recognition, and an infringement of this guarantee through any statute would be considered unconstitutional according to state law.
Although statutes in New Mexico law do not explicitly ban gay marriage, the state still prohibits gay couples to marry. Despite several lawsuits filed against county clerks who refused to issue marriage license, 64 same-sex couples were married in New Mexico when clerks concluded that the law did not explicitly ban them in 2004. The city of Santa Fe also passed a measure that endorsed same-sex marriage.
It remains unknown whether the Supreme Court will resolve this dispute over the legality of same-sex marriage, and no hearing has been scheduled yet. Although New Mexico bans gay marriage, the law can be challenged on constitutional grounds. The Supreme Court can take a firm stance and decide to strike down an unconstitutional law and thus contribute to the fight for human rights taking place throughout the country. We applaud your announcement that as New Mexico’s Attorney General you will not defend the ban on same-sex marriage because it is unconstitutional. Furthermore, your urging of the New Mexico Supreme Court to make a firm decision on the issue of gay marriage by invalidating an unconstitutional law will hopefully compel them to contribute to the advancement of gay rights in New Mexico.
We also applaud your rational for your decision. Denying marriage licenses to gay couples directly violates the state constitution, especially its Equal Rights Amendment that guarantees equal protection and legal recognition of marriages under the law. We applaud your endorsement of same-sex marriage and urge you to continue to advocate for human rights in New Mexico and elsewhere in all of your future political endeavors.
