Goal: Applaud Attorney General Kane for supporting marriage equality
The Supreme Court’s ruling on the federal Defense of Marriage Act requires the federal government to recognize gay marriage in states where it has been legalized. The overturning of DOMA was a landmark decision in the fight for gay rights. In the state of Pennsylvania, an ongoing lawsuit has been debating the Pennsylvania Defense of Marriage Act. The law defines marriage as between one man and one woman, just like the federal Defense of Marriage Act.
The American Civil Liberties Union filed suit against the state of Pennsylvania for the state’s DOMA. The plaintiffs consist mainly of same-sex couples, and the case being argued is that the state’s DOMA violates the 14th Amendment’s Equal Protection Clause. The Attorney General of Pennsylvania, Kathleen Kane, was supposed to defend the state. She is a Democrat who believes that every American, regardless of gender, has the right to get married. Kane declined to argue for Pennsylvania, so Governor Corbett, an opponent of equal marriage, must find another state attorney.
Kane spoke recently about her decision, saying “We are the land of the free and the home of the brave and I want to start acting like that.” She explained that her moral views did not allow her to defend Pennsylvania in this case. Attorney General Kathleen Kane did the right thing by refusing to defend a discriminative act. Commend her for her decision to support equality by signing the petition below.
Dear Attorney General Kane,
As Attorney General of Pennsylvania you were expected to defend the state’s Defense of Marriage Act, which defines marriage as between one man and one woman in the state. You decided to reject defending the state’s discriminative act, and that was the right thing to do. You are a supporter of marriage equality and it is only right that you stay true to what you believe in.
The American Civil Liberties Union has sued on the basis that DOMA goes against the 14th Amendment’s equal protection clause. The Republican Governor Corbett who is an opponent of same-sex marriage can choose to find another state lawyer to represent the state in this case, knowing that you are not an option. Your statements about your refusal to defend Pennsylvania were very bold and showed Americans that you will do what is morally just.
Now more states are legalizing gay marriage, especially after the Supreme Court’s ruling on the federal Defense of Marriage Act. It is a controversial issue but there is a clear side that is morally right. Thank you for standing on that side.
