Stop Unconstitutional Searches and Seizures Within 100 Miles of U.S. Borders

Target: President Obama and Janet Napolitano (Secretary of Homeland Security)

Goal: Remove Fourth Amendment free zones near U.S. borders, where officials can now disregard the constitutional rights of American citizens, and keep our government liable to the Constitution.

The Department of Homeland Security has declared what the government refers to as “Fourth Amendment free zones” within 100 miles of the U.S. border.  The Fourth Amendment protects all citizens from illegal searches and seizures. As part of the Bill of Rights, it is considered an inalienable right.

Even though drug trafficking, drug related violence, and terrorist plots near the U.S. border has reached an all time high, the Fourth Amendment is a part of the single most important section of the United States Constitution—the basis of our freedoms, the foundation of governmental boundaries.  These amendments are not supposed to be interpreted as optional; they are written in stone and must be followed to the letter.

In addition, two-thirds of the U.S. population, 197.4 million people, live within this zone. Not only does this 100 mile Fourth Amendment free zone include entire states, such as Connecticut, Delaware, Florida, Hawaii, Maine, Massachusetts, Michigan, New Hampshire, New Jersey, New York, Rhode Island, and Vermont, but it also includes nine of the top ten metropolitan areas in the country.

This exception to the Fourth Amendment can be seen as nothing other than an absurd abuse of governmental power. There is plenty of security on US borders, and superseding the Constitution to get a leg up on criminals is not only futile, but also a disgrace to the Constitution and the Bill of Rights.

Dear President Obama and Janet Napolitano,

The decision to allow Fourth Amendment free zones within 100 miles of U.S. borders is an extreme measure in order to combat drug trafficking and terrorism.  As part of the Bill of Rights, the Fourth Amendment, which protects us against unreasonable searches and seizures, is one of our country’s most sacred laws and must be followed to the letter.

Two-thirds of the U.S. population, 197.4 million people, live within this newly declared Fourth Amendment free zone. Not only does this include entire states, such as Connecticut, Delaware, Florida, Hawaii, Maine, Massachusetts, Michigan, New Hampshire, New Jersey, New York, Rhode Island, and Vermont, but it also includes nine of the top ten metropolitan areas in the country.

The war on drugs and terror is one of never-ending attrition, especially as long as America’s demand for illegal drugs skyrockets and hatred of America’s freedoms persist.  Superseding a cornerstone of the Constitution, and discrediting the very freedoms this government swore to protect, is not the way to combat these evils.

Please do all that you can to over turn this drastic legislation for Fourth Amendment free zones, and keep our government subservient to the laws established in the US Constitution.
