Stop Kansas Courts from Enforcing Unconstitutional Law that Strips Women’s Health Centers from Federal Funds

Target: Kansas Court of Appeals
Goal:  Restore Title X Federal Funds to women’s health clinics.
Kansas approved a law that illegally restricts the federal funding provided under Title X, for family planning and reproductive health services.

Federal law indicates that any institution, federal or private may apply for those funds under Title X. The Kansas law restricts those funds to only public institutions. The reasoning behind the law is to pull the funds away from institutions that provide abortions. There is one caveat, not all private entities who received a portion of those funds are abortion providers. The Dodge City Planning Clinic (DCFP) has never provided abortion services, and yet is now facing de-funding. They have played a critical role in their community for the past 35 years, providing pregnancy tests, contraception, PAP smears, cancer screenings, among other preventive health care, for a low affordable cost to the community.

The women in Ford County who depended on these services are the latest casualties in Kansas overzealous war on reproductive freedom. The ACLU is getting involved in the battle. The chief counsel and legal director of the ACLU Kansas and Western Missouri, Doug Booney, said “We are asking the court to immediately block further enforcement of this law so all health-care providers in the state, including DCFP, can continue to provide health-care to the patients who count on them.”

Please join the American Civil Liberties Union (ACLU) in this very important battle for women’s health and reproductive freedom, and tell the court to block the enforcement of this law, and restore the federal funds to private institutions as provided by federal law.

Dear Kansas Court of Appeals:
Please stop further enforcement of the law that removes Title X funds from private institutions. This is only an attempt to restrict access to reproductive health care. Organizations like the Dodge City Planning Clinic (DCFP), who do not provide any abortion services, are being forced to shut down because of this law. The many women who received affordable health services such as PAP smears, cancer screenings, treatment for sexually transmitted diseases, and other preventive health services are casualties of the latest attempt to restrict reproductive freedom. They deserve to a continuation in their low cost services in their community.

Please stop further enforcement of this law, and allow clinics like the DCFP to apply and receive funding from Title X.
