Bring Charges Against Alleged Inciters of Deadly Capitol Riots

Target: Merrick Garland, Nominee for Attorney General of the United States

Goal: Seek charges against individuals who allegedly incited the mob that stormed the Capitol.

Five people lost their lives during or directly after the Capitol insurrection. Since that day, two Capitol police officers have committed suicide. The long-term damage still lingers, with National Guard troops indefinitely providing security for the building and the people working inside. Unfortunately, the domestic terrorism threats also continue, as evidenced by a man who was taken into custody reportedly armed with weapons and a list of Congress members.

The new Department of Justice has quite a task on its hands, with 100-plus arrests made so far and more to come. Potential charges could include burglary, assault, trespassing, seditious conspiracy, manslaughter, incitement, and more. These potential indictments could carry hefty prison terms, but the latter accusation has caused the most controversy. Should individuals who seemingly riled up these suspects with hostile rhetoric in the hours and even the weeks before the insurrection face legal punishment?

The Supreme Court apparently answered this question with a precedent-setting case where it ruled that free speech protections cannot be used for words “directed to inciting or producing imminent lawless action and is likely to incite or produce such action.” Several prominent politicians, including the former President of the United States, engaged in such behavior in a very public manner. These politicians should not fall under a different set of rules than the everyday citizens they allegedly incited to violence.

Dear Mr. Garland,

The aftermath of the Capitol insurrection presents one of your most daunting challenges if you are confirmed as Attorney General. The decisions you make may very well define your tenure. Many arrests have been made involving the people allegedly at Ground Zero of this crisis. But every crisis has an origin.

True justice cannot be delivered in this tragic case if anyone appears above the law and therefore immune from ultimate consequences. Every individual who incited this mob had a hand in the events that unfolded…a guiding hand. They arguably bear more responsibility than the foot soldiers they allegedly deployed. The Supreme Court once ruled that such inciters were not shielded from the damage they wrought by claims of free speech.

Please honor the laws of this country and demonstrate that they apply to everyone, regardless of status or privilege. Indict all involved parties in the Capitol insurrection.
