Trump: Do Not Grant Preemptive Presidential Pardons to Family and Personal Lawyer

Goal: Do not grant preemptive pardons to your family and personal lawyer.

President Trump has discussed the possibility of granting preemptive pardons to his children, son-in-law, and his personal lawyer as a defense against possible retribution from a Biden Justice Department. The discussed pardons would cover Donald Trump, Jr., Eric Trump, Ivanka Trump, Jared Kushner, and Rudolph Giuliani.

Anticipated pardons could potentially cover alleged infractions such as contact that Donald Trump, Jr. had with Russians who offered damaging information on Hillary Clinton, or Jared Kushner providing false information to federal authorities about his contact with foreigners for his security clearance. It is not currently clear what potential criminal activity Eric Trump or Ivanka Trump could be accused of and experts do not know why President Trump would want to include these two children in his pardons. The potential criminal exposure of Giuliani is also unclear, although he has been investigated for alleged dealings in Ukraine.

While presidential pardons provide protection against the federal law, they do not cover state or local crimes. The discussion of pardons coming from the White House highlights just how common investigations and criminal prosecutions within the President’s close circle have been.

The President of the United States is a position that is inherently devoid of any dictatorial powers. It is not a family dynasty. It is not a position that is above the law. In fact, the President of the United States is the foremost civil servant in the country and should behave as such. The powers of the office should not be used to protect those closest to the president or to condone illegal activity or criminal exposure.

Your administration has been plagued by investigation after investigation as the actions and motivations of the people closest to you–including some of your family–are called into question. You must allow the justice system to do the work that is necessary to maintain the moral foundation of our country and our democracy. I urge you to not grand preemptive presidential pardons to your children, son-in-law, and personal lawyer.
