Dismiss Border Patrol Agent Who Allegedly Detained Women for Speaking Spanish

Target: Kevin K. McAleenan, U.S. Customs and Border Protection Commissioner

Goal: Fire agent who allegedly detained two women for communicating in Spanish.

Two women speaking Spanish while in line at a convenience store were reportedly detained by border control. Ana Suda and Mimi Hernandez were allegedly interrogated by border patrol during a midnight run for milk and eggs in Havre, Montana, near the US-Canadian border. The two legal Mexican-American citizens were detained and questioned in the parking lot for approximately 40 minutes – reportedly for exchanging a few words to each other in Spanish.

Recorded on camera and widely circulated on the internet, the agent explicitly admitted that he demanded to see identification after hearing the women speak a language other than English. What he doesn’t realize is that racial profiling and arbitrary searches are illegal under the U.S. Constitution. To counteract the ongoing smear campaign against immigrants in the United States, sign the petition to demand disciplinary action against the federal employee.


Dear Commissioner McAleenan,

Since when did being bilingual become a criminal offense in the United States? Recently, two Mexican-Americans were reportedly, unlawfully questioned by border patrol in the parking lot of a convenience store in Havre, Montana after speaking to each other in Spanish while waiting to check out. According to testimonies, the agent allegedly followed the women outside and demanded to see their identification. Now one of the plaintiffs is requesting legal guidance from the American Civil Liberties Union (ACLU) to potentially press charges.

Hear us loud and clear – speaking another language isn’t a sufficient reason to stop or arrest someone, according to the ACLU. As your organization reviews the incident to ensure procedures were appropriately followed, don’t forget that millions of legal citizens speak more than one language. To underestimate this would only result in more racial profiling cases and unchecked ignorance. Hold your colleagues accountable and dismiss the agent involved if he is found guilty.
