Goal: Remove Judge Derek Johnson from power
California Superior Court Judge Derek Johnson was recently reprimanded after a rape trial in which he accused the victim of “not putting up a fight,” and claimed, “If someone doesn’t want to have sexual intercourse, the body shuts down.” Though Johnson got a very public slap on the wrist, he still retains his job on the bench. Demand that he be removed from his position.
The case involved Metin Reza Gurel and his ex-girlfriend. Not only did Gurel rape the victim, but also beat her with a metal baton and threatened to mutilate her face and genitals with a heated screwdriver. The prosecution asked for Gurel to be put away for 16 years, but Judge Johnson said it was only worth six.
The incident happened in 2008, but wasn’t reported until May of 2012. Ironically enough, this was just months before Congressman Todd Akin made a disturbingly similar comment. Akin, in the midst of a campaign for Senate, said that if it is a “legitimate rape,” a woman’s body has a way of shutting down to prevent pregnancy. These men are absolutely ludicrous.
It is clear that even high-ranking individuals are ignorant about the seriousness of sexual assault and about the female anatomy in general. It is embarrassing for the U.S. that a Superior Court Judge, someone who decides what is just, would think that it only counts as rape if the victim puts up a fight. There is no room in the government or modern society for men who think a victim was asking for an assault because their body didn’t “shut down.” This is a slap in the face to anyone that has been a victim of rape. By signing this petition, you are demanding that men who belittle rape or make sexist remarks about how women’s bodies are supposed to act during a sexual assault be removed from positions of power in the government.
Dear California Commission on Judicial Performance,
I am writing to you about remarks made by Superior Court Judge Derek Johnson. Johnson made extremely offensive comments in a rape case where he belittled the horrific act of rape by putting blame on the victim for not “putting up a fight,” and making absurd claims about a woman’s body being able to shut down to prevent rape.
It is difficult to realize that people still have this mindset in 2012, especially someone who is a member of the judicial system. Not only are these comments damaging to the victim, but they are damaging to any person who has ever been the victim of a sexual assault. The damage done by Johnson is irreversible. Please, tell the public that this behavior is unacceptable by removing Johnson from his seat.
