Do Not Criminalize Same-Sex Relationships and Consensual Sex

Goal: Do not alter the Criminal Code to make consensual sex between unmarried couples illegal.

Politicians in Indonesia are considering making all sex before marriage illegal. Criminalizing sex between two consenting adults is a massive violation of human rights. It would also effectively forbid homosexual relationships altogether, as the country does not recognize gay marriage.

The bill is a revision of Indonesia’s Criminal Code, and would expand the definition of adultery. Currently, only pedophilia is prohibited, but if the bill passes, all consensual sex between two unmarried persons would be criminal. Many are rightfully outraged, especially since this bill would only increase “victimless crimes” while protecting no one. As Ratna Batara Munti from the Women’s Legal Aid foundation stated, “The government should not arbitrarily take away personal freedoms in the name of morality.” Sign below to demand that Indonesia not criminalize sex between unmarried persons.


Dear House Speaker Soesatyo,

It is a gross violation of human rights to criminalize consensual sex between two unmarried adults. The expansion of the definition of adultery that is being proposed in a bill revising Indonesia’s Criminal Code does not protect anyone, and would only serve to increase the number of victimless crimes in the country. It is especially discriminatory against the LGBTQ community, who would be unable to enter into any legal relationship if the bill passes (since gay marriage is not yet recognized).

As Imam Nahe’i, an Islamic teacher and Komnas Perempuan commissioner points out, “The level of evidence needed to prove adultery is very high in Islam. To prove murder, you only need two witnesses. To prove adultery, you need four witnesses.” From a Muslim perspective and going by these standards, the definition of adultery should be narrowed, not broadened. Further, it is not the place of the government to strip citizens of their rights on a whim, under the guise of morality. I urge you to ensure that consensual sex between two unmarried adults remains legal in Indonesia.
