Stop Texas From Making Plastic Bag Bans Illegal

Goal: Stop the Texas Supreme Court from making plastic bag bans illegal.

Plastic bag bans are spreading like wildfire across the nation. Mostly on the city level, these laws ban the use of single-use plastic bags and have stores charge a fee for using a plastic bag. The bans are meant to reduce the amount of single-use plastic bags put out into the environment where they harm animal life and create pollution.

However, plaintiffs in the case of Laredo Merchants Association v. The City of Laredo, currently in the Texas Supreme Court, want to make these plastic bag bans illegal across the state. The merchants’ association believes the bans are illegal according to an existing state law concerning solid waste disposal. The law states local governments may not “prohibit or restrict, for solid waste management purposes, the sale or use of a container or package in a manner not authorized by state law.”

This excerpt comes from the Texas Health and Safety code. Since the bags are primarily used for carrying purchases from the store, the “solid waste management purposes” should not apply to these bans. Sign this petition to stop the court from making these bans illegal across the state of Texas. Let the Justices know the environment is more important than one line of irrelevant health code.

PETITION LETTER:

Dear Texas Supreme Court Justices,

Plaintiffs in the case of Laredo Merchants Association v. The City of Laredo are trying to make plastic bag bans on the local level illegal. Overturning these local bans and prohibiting any further bans in the entire state will be detrimental to environmental progress across the nation. Plastic is ruining the natural order of ecosystems while polluting oceans and harming animal life. This material takes hundreds of years to degrade, and will only shrink down until animals and humans are consuming it.

Set a good precedent, and uphold the legality of single-use plastic bag bans. Their importance or value is minuscule considering the plethora of other options available for carrying purchases. Take this important step towards eliminating toxic and harmful plastic in the American way of life. Officials at the local levels of government have begun to speak for their citizens, and these people want to reduce harmful practices. Please listen to the citizens of your state, and work toward a cleaner, plastic-free world.

    To be sure, this is all about making it easier for businesses to get their hands on peoples’ hard-earned money, i.e make it easier to shop ’til they drop. God forbid, someone who is using their own reusable bag has the profits-harming idea to stop shopping when their bags are full. We wouldn’t want that to happen now would we? Mindless spending must go on, even if the environment is destroyed, our neighborhoods look like crap from discarded plastic bags hurling through them like tumple weed.
    But look, it doesn’t have to be that way. Let us not forget that we as the consumers have the choice to not use plastic bags. No, it’s not inconvenient. Just keep a set in the back seat ready to go. Also, when you are at a store where baggers use plastic bags like they get a bonus for using as many as they can (Walmart comes to mind!), ask them to downsize. But best not use them at all. Unlike the CEO of Walmarts and other retail stores, we don’t have low-wage laborers to keep our estates free of trash or a vial on a remote and still pristine island.

    stop it! no lifts on the plastic ban. its illegal to litter. its illegal to not recycle. plastic is bad for the environment. you treat us humans like plastic objects but were not!
