Microsoft: Don’t Collect Our Private Data

Goal: Don’t collect private user data without proper consent.

Microsoft routinely collects private data from Windows 10 users without adequate consent, according to a Dutch privacy watchdog. “The company does not clearly inform users that it continuously collects personal data about the usage of apps and web surfing behavior through its web browser Edge, when the default settings are used,” the Dutch Data Protection Authority (DPA) alleged.

According to the DPA, the collected data is used to provide users with targeted advertisements and recommendations. While the DPA concluded the computer giant does technically inform users of this, “Microsoft does not clearly inform users about the type of data it uses, and for which purpose.”

During installation of Windows 10, the DPA alleged, users are also nudged to accept default privacy settles that enable “full telemetry,” which allows for private data like browsing history to be sent to Microsoft. To stop this, users must actively opt out of this function, according to the DPA. “If a person does not actively change the default settings during installation, it does not mean he or she thereby gives consent for the use of his or her personal data,” the DPA said.

The Dutch Data Protection Authority (DPA) has accused Microsoft of collecting private user data without proper consent. According to the DPA, during installation of Windows 10, users are nudged to accept default privacy options, which allow Microsoft to automatically collect app use and browser history.

“It turns out that Microsoft’s operating system follows about every step you take on your computer. That results in an intrusive profile of yourself,” said Wilbert Tomesen, vice-chairman of the DPA. “What does that mean? Do people know about this, do they want this? Microsoft needs to give users a fair opportunity to decide about this themselves.”

We demand you give users this fair opportunity, and take steps to be more open about Microsoft’s data collection. We also demand Microsoft immediately stop automatically collecting this data, until it can request consent in a clearer manner.
