Do Not Fire Navy Officer for Being Transgender

Goal: Do not discharge naval officer who underwent sex reassignment surgery.

An Indian naval officer has received notice that she will be discharged from service because of her sex change surgery, despite the fact that transgender people are legally recognized as a third gender in India. This has rightfully sparked outrage regarding transgender civil rights, and the naval officer Sabi (formerly Manish Giri) has said that she will appeal this decision in military court.

In a statement, the navy said that “rules and regulations do not permit the sailor’s continued employment” due to “irreversible gender reassignment,” even though India’s court system ruled in 2012 to legally allow adult men to undergo sex change surgery, and in 2014 to recognize the transgender community as a third gender. Sabi, who had surgery while on leave after serving in the Navy for six years, alleges that when she returned to work she was forced into confinement in the psychiatric ward for almost five months, which she says “was like being in jail.” Sabi stated her determination to fight for “justice,” saying, “I am not a criminal, I have done nothing wrong, I have only revealed my true identity.”

The decision to discharge naval officer Sabi for undergoing gender reassignment surgery is a blatant violation of human rights. Transgender people are legally recognized as a third gender in India, and there is no legal bar for adult men having this kind of surgery. Sabi is not in violation of any law, and to discharge her for revealing her true self is unacceptable.

Sabi has faithfully served the Indian navy since 2010. It is a miscarriage of justice to fire her or to treat her any differently because of her gender. I urge you to overturn the decision to discharge Sabi from the naval forces.
