A lawsuit is being brought against the Clovis Unified School District of California which claims that the sex-education program practiced in that district violates state law. Clovis Unified School District practices abstinence-only sex education, a method which touts abstaining from sex as the only 100% effective way to prevent pregnancy and STDs. A federal study on sex-ed that stresses abstinence found that it had no impact on the rate of sexual abstinence among teens: moreover, states that practice it rank highest in number of underage pregnancies. It also ignores the needs of LGBT students, who need to know how to have safe sex regardless of whether that sex presents a risk of pregnancy. Since California law mandates that all sex-education curriculum be comprehensive, accurate, bias-free, and appropriate for students of all sexual orientations, the abstinence-only program practiced at Clovis is out of line with state law, according to the coalition which brought the lawsuit.
Some of the suggestions made by the textbooks used in the district about how to prevent pregnancy include abstaining from sex, respecting yourself, getting lots of rest, and hanging out in groups. Other instructional materials allegedly compare non-virgin women to dirty shoes and assert that men are incapable of stopping themselves once sexually aroused.
The coalition bringing the lawsuit is made up of two parents, a district of The American Academy of Pediatrics, and the Gay-Straight Alliance Network. They are represented by the American Civil Liberties Union (ACLU) and the law firm of Simpson Thatcher and Bartlett LLP. I am writing concerning the lawsuit you recently brought against Clovis Unified School District in California, for which you are being represented by the ACLU and the law firm of Simpson Thatcher and Bartlett LLP. I support your claim that Clovis’s sex-education curriculum, which stresses abstinence and does little to educate on other methods of preventing pregnancy and the spread of STDS, is illegal under California state law. Abstinence-only education has been proven to be wildly ineffective in preventing pregnancy or even promoting abstinence, and the states in which it is practiced rank among the highest in rates of underage pregnancy. It also does nothing to educate LGBT students, who need to know how to practice safe-sex regardless of whether that sex presents a risk of pregnancy.
