Stop Monsanto’s Attacks Against Family Farmers

Target: The Court of Appeals for the Federal Circuit

Goal: Grant farmers the right to protect themselves from being accused of patent infringement by Monsanto.

In 2011, 75 family farmers, seed businesses and agricultural organizations that represented 300,000 individuals and 4,500 farms brought a protective legal action against Monsanto, opening a suit known as Organic Seed Growers and Trade Association et al. v Monsanto. The association argues for the creation of a ruling to ensure that Monsanto cannot sue them for patent infringement if their crops get contaminated by Monsanto’s genetically modified seeds. Though the case was dismissed by the district court in February of 2012, it is now awaiting review by the Federal Circuit Court of Appeals.

Now, eleven distinguished law professors and 14 prominent non-profit organizations in related fields have filed separate briefs with the Court of Appeals in support of the farmers, seed businesses and agricultural organizations. They argue that the farmers have a right to protect themselves from being accused by Monsanto, because the agricultural giant continues to refuse never to sue contaminated farmers for patent infringement.

By voicing support for the Organic Seed Growers and Trade Association, the lawyers and non-profit organizations are reinforcing the legitimacy of the case against Monsanto and providing a real chance for the Court to vote in favor of family farmers. If the members of the Court also see that the Association has significant public support, they are more likely to protect farmers from Monsanto’s underhanded tactics to control agriculture.

I am writing to urge you to rule in favor of the 75 farmers, seed businesses and agricultural organizations representing 300,000 individuals and 4,500 farms in the suit known as Organic Seed Growers and Trade Association et al. v Monsanto. Monsanto is an agricultural giant known for using underhanded tactics to control agriculture, and the Organic Association simply seeks to protect the livelihood of family farmers from being unfairly sued for patent infringement if their crops get contaminated by Monsanto’s genetically modified seeds.

The quantity and variety of people, businesses and organizations that recognize the need to protect family farmers from Monsanto’s lawsuits show just how much of a threat the agricultural giant is to families seeking to earn an honest living.
