Stop Texas Governor Rick Perry from Refusing to Implement ‘ObamaCare’

Target: Governor Rick Perry

Goal: Immediately implement the Affordable Care Act (ObamaCare), as mandated by federal law.

With the Supreme Court confirming the constitutionality of the Affordable Care Act, also known as “ObamaCare,” comes the issue of implementing the new law; this implementation takes place on both the state and federal levels, and will require a great deal of effort. Two vital state level components of the Affordable Care Act are the expansions of state Medicaid programs and the establishment of state health insurance exchanges. The implementation of these provisions is left up to the individual state governments, and each state has a great deal of leeway in determining how the provisions are enacted.

Rick Perry, the current governor of Texas, has announced that he will implement neither the Medicaid expansion, nor the creation of state health insurance exchanges. This refusal, while arguably legal, is bordering on nullification (the unconstitutional refusal of a state to comply with federal law) and is inarguably damaging to the citizens of Texas. Not only are these provisions of the ACA beneficial, but Texas’s “last in the nation” rank for health insurance means that Texas needs this help more than any other state.

The provisions which Governor Perry is planning on blocking will help millions of Texans. The expansion of Medicaid under the ACA will allow nearly 1.8 million Texans to obtain health care coverage for the first time. Health insurance exchanges, such as the ones created under the ACA, will increase the numbers of people in the insurance pool and allow Texans to buy insurance at a decreased rate.

Sign this petition in order to demand that Rick Perry fully implement the state level provisions of the ACA. The refusal to implement such beneficial provisions is merely politics, yet the results of the refusal would harm millions of Texans.

PETITION LETTER:

Dear Governor Rick Perry,

During recent speaking engagements, you have indicated that you will not implement the state level provisions of the Affordable Care Act (“ObamaCare”), despite the significant benefits such provisions would benefit your state’s citizens. The provisions in question—the creation of state health care exchanges and the expansion of the state Medicaid program—would help millions of Texans access health care, and a refusal to implement them is pure politics.

Texas currently has the highest uninsured rate (25% uninsured) of any state. The ACA provisions which you are blocking would potentially cut this rate in half and allow millions of Texans to access federally subsidized health insurance.

The ACA is a constitutional law, passed by duly elected federal legislators, and is the binding law of the land. States cannot be allowed to de-facto nullify laws which they disagree with politically, thus your efforts to stop this law’s implementation are completely wrong-headed.

I, as well as everybody else to sign this petition, demand that you immediately begin a full implementation of the ACA within your state. The refusal to implement the ACA is nothing more than a partisan snub against federal Democratic legislators, but this snub will also cause a significant amount of damage to the health care access of millions of Texans; clearly, this political move is not worth the cost to your constituency.
