Demand Justice for Abandoned Dog

Target: District Attorney William Clark Everett

Goal: Demand the maximum sentence be assigned to Darrell Montese Overton and Nicole Phillips for abandoning their dog in an empty apartment.

Mr. Darrell Montese Overton and his girlfriend Nicole Phillips are being charged with cruelty to animals and animal abandonment for moving and leaving a pit bull puppy behind. The dog reportedly belonged to Phillips, but was being cared for by Overton in his Greenville, NC apartment. When Overton moved earlier this summer, he reportedly left the 8-month-old puppy behind locked inside a cage. Utilities to the apartment had been shut off, and the puppy went about a week without access to water.

Darrell Montese Overton and Nicole Phillips are both Eastern Carolina University students. Overton played for the university’s football team, the Pirates, but was suspended from the team following his arrest. The team’s head coach, Ruffin McNeill, stated that Overton had “been a model student-athlete in our program” prior to his animal cruelty charge. Animal control was called to take custody of the abandoned puppy. Overton and Phillips were both described as ‘belligerent’ by Animal Control and issued conflicting accounts of the situation. Overton refused to willingly surrender the abandoned dog to Animal Control.

Animal Control officers did seize the puppy and it was described as being in ‘good condition’ despite its week alone in the empty apartment. Overton and Phillips were arrested and then released on bond. The puppy remains in Animal Control’s custody.

By signing this petition, you are requesting that, if proven guilty, Darrell Montese Overton and Nicole Phillips be prosecuted to the fullest extent of the law. Luckily the puppy they abandoned survived. However, their irresponsible and cruel deed should not go unpunished.


Dear District Attorney William Clark Everett,

If Darrell Montese Overton and Nicole Phillips are found guilty to their charges of cruelty to animals and abandonment of animals, please consider sentencing them to the fullest extent of the law. The young puppy they abandoned in their empty apartment was lucky to have survived its ordeal. Do not give Phillips and Overton the opportunity to abandon another innocent animal, or the next one may not be as lucky as the first.  Thank you.

  1. Too many incompetent idiots purchase animals without realizing that they have to care for those who cannot care for themselves and will die if abandoned.

  2. The evil that exists out there is truly horrifying. What compels people to inflict the most horrific abuse on innocent and trusting animals is beyond comprehension. If there is justice in this world, these individuals will pay for their heartless crimes.
