Newt Gingrich: Explain Obstruction of Justice Comment

Goal: Explain comment saying that the president “cannot obstruct justice.”

Newt Gingrich said in a recent interview that it’s not possible for Donald Trump to obstruct justice as the president. Gingrich said, “Technically, the President of the United States cannot obstruct justice. The President of the United States is the chief executive officer of the United States. If he wants to fire the FBI director, all he’s got to do is fire him.” He added that the investigation of Trump is a “witch hunt.”

Of course, it’s very possible for an American president to obstruct justice. Bill Clinton was charged with perjury and obstruction of justice when impeachment proceedings were brought against him in 1998. Gingrich was Speaker of the House at the time and voted in favor of impeachment.

Mr. Gingrich appears to believe that Democratic presidents are capable of obstructing justice, to the point of voting for Clinton’s impeachment, but that Donald Trump’s position as president makes obstructing justice impossible. In a recent interview, you said that because Donald Trump is the president, it’s impossible for him to obstruct justice. You characterized the investigation into President Trump as a “witch hunt” as well. However, when Bill Clinton was president, he was charged with both obstruction of justice and perjury, and as Speaker of the House at the time, you voted to impeach him.

It’s irresponsibly biased to suggest that Trump’s presidency makes obstruction of justice impossible for him when you evidently did not believe this about Bill Clinton. I strongly urge you to explain why you think the position of president functions differently for President Trump than it did for a Democrat whom you voted to impeach.
