Do Not Allow Any Conflicts of Interest Within the Russia Investigation

Target: Deputy Attorney General Rod Rosenstein

Goal: Recuse yourself from Russia probe to avoid complicating or compromising the investigation.

Deputy Attorney General Rod Rosenstein acknowledged to his colleagues that he may need to recuse himself from the Russia probe as its scope widens to include an inquiry into the possibility that President Trump attempted an obstruction of justice. He became the senior Justice Department official with final authority over the special counsel’s probe after Attorney General Sessions’s recusal. He also recommended the firing of James Comey as FBI director–a major cause of the investigation into whether Trump obstructed justice.

Two months after he took command of the investigation, Rosenstein composed the letter recommending that James Comey be fired, at President Trump’s behest. Rosenstein could become a key witness in the investigation, which could be a conflict of interest if he is still the one making the final decisions about resources, personnel, and prosecutions within the probe. Dear Deputy Attorney General Rosenstein,

As you said yourself when you selected former FBI director Robert Mueller to oversee the Russia probe, “The public interest requires me to place this investigation under a person who exercises a degree of independence from the normal chain of command.” This standard must apply to you as well, as the person with the final say over vital investigation matters.

The recommendation you wrote advising President Trump to fire James Comey could make you a key witness for the inquiry into whether President Trump attempted to obstruct justice. This is included in the scope of the Russia investigation, and should you become a key witness as well as remain in a position of authority for the probe, it would be a conflict of interest. Our country and our democracy are at stake, and it is imperative that the investigation is carried out without any political or personal bias. I urge you to recuse yourself from the Russia probe.
