Don’t Jail Low-Level Drug Offenders for Decades

Target: Jeff Sessions, U.S. Attorney General

Goal: Maintain guidelines to avoid triggering harmful mandatory minimum sentences for low-level drug offenders.

As the Trump administration ramps up its war on drugs, low-level criminals arrested for nonviolent drug crimes could now face decades behind bars following guidelines recently issued by Attorney General Jeff Sessions. In a new memo, Sessions instructs federal prosecutors to reverse Obama-era practices and makes it a “core principle” to charge criminals with “the most serious, readily provable offense.” In practice, this means that drug offenders who pose no danger to society may spend the rest of their lives in prison, even if they have simply been caught with marijuana, which is still highly illegal at the federal level but legalized in some form in over half of U.S. states.

Mandatory minimum sentences require judges to put criminals in prison for a certain number of years, making them inflexible to the particular circumstances of low-level crimes and causing prison populations to climb while costing precious taxpayer dollars and diverting resources from law enforcement. Sign this petition to demand Sessions’ memo be rescinded to prevent nonviolent drug offenders from being ripped from their jobs, homes, and families to cruelly waste away in the prison system.

Dear Attorney General Sessions,

I write today to express my outrage at your recent memo encouraging prosecutors to charge criminals with “the most serious, readily provable offense.” Under this new policy, low-level drug offenders who pose little threat to society will face mandatory minimum sentences that force them to spend the rest of their lives behind bars due to a mistake gone wrong or even the absurd disparity between federal and state enforcement of marijuana laws.

Mandatory minimum sentences do not allow judges to fit punishments to the circumstances of a crime, forcing low-level criminals to spend years behind bars and causing prison populations to soar at the expense of taxpayer money and law enforcement resources. I urge you to rescind your memo and allow prosecutors and judges to do their jobs as they see fit to protect nonviolent criminals from losing their lives to the federal prison system.
