Remove Outdated Ban on Same-Sex Intercourse

Target: Sam Brownback, Governor of Kansas

Goal: Remove law that labels same sex intercourse as a criminal offense.

It might seen startling, but Kansas still has an old law that officially bans sexual intercourse between two people of the same sex. That’s right, in the 21st Century, sex between two consenting adults in Kansas can be considered “sodomy.” The law in question is Statute 21-5504, which defines “criminal sodomy” as “sodomy between persons who are 16 or more years of age and members of the same sex.” The statute goes on to put sex between two people of the same sex in the same category as bestiality and some forms of child abuse.

Interestingly, this statute was ruled unenforceable in a 2003 court case. At this point, the law simply remains on the books as a testament to the state’s history of repressing its LGBT community. In effect, it’s a constant reminder that technically speaking, same sex relationships are considered no more legitimate than abusing animals and children. Removing Statute 21-5504 from the law books would be a major step forward for the state, and serve as a break from Kansas’ dark past. PETITION LETTER:

Dear Governor Brownback,

Kansas is among an ever-shrinking handful of states that still has anti-sodomy legislation targeting members of the LGBT community. Under the antiquated Statute 21-5504, sex between two consenting adults of the same sex is still technically considered a form of sodomy in Kansas. In fact, it’s listed in the same category as bestiality and some forms of child abuse.

This law is so outdated, it was even ruled unenforceable as far back as 2003. This therefore begs the question: why does this law even remain on the books? In the modern day, labeling same sex relationships as sodomy, and equating them to bestiality is simply wrong. It’s not only offensive toward Kansas’ LGBT community, but to all people who believe in personal freedom and the right to live without undue discrimination and government interference in private affairs.

We therefore urge you to endorse the immediate abolition of Statute 21-5504. This offensive relic of the past should be relegated to the dustbin of history, where it belongs.
