Demand Health Care Transparency in California

Target: Senator Ed Hernandez, chair of the California Senate Health Committee

Goal: Ensure all Californians receive accurate information about their health insurance.

In 2014, as many as 7 million Californians will gain access to health care thanks to Obama’s Affordable Care Act. That’s fantastic news, but additional measures must still be taken to ensure all Californians receive clear, accurate information about their new health insurance plans. Senator Ted Lieu has announced legislation that would protect every family covered under the Affordable Care Act from misrepresentation of their health care coverage.

The people most in need of insurance under ACA are also the people least likely to be informed of its details. Many newly-immigrated families now living in California will soon be eligible for coverage, but language barriers and lack of access to intelligible insurance information could leave residents in the dark when it comes to making their health care decisions. As the legislation stands now, unscrupulous insurance representatives could easily misrepresent the requirements of ACA, hoping to extort vulnerable families by selling them plans they don’t need.

We need additional protections in place to make sure ACA works as intended to bring appropriate coverage to millions of uninsured families. Without legal safeguards, we run the risk of allowing scam artists to take advantage of consumers as they navigate their insurance decisions. The proposed bill would ensure that all health care plan information is properly represented and correctly translated, preventing predatory insurers from selling superfluous products to families in need. Support Senator Lieu as he fights for every Californian’s right to accurate information about their own health care. The Affordable Care Act will make great strides in ensuring all Californians have affordable access to adequate health care. But the act as it stands isn’t enough. We need additional legislation to make sure that insurers don’t extort families that rely upon ACA for their health care coverage.

California is one of the most culturally diverse states in the country. It’s home to a rich variety of families, all with their own stories and futures. The state legislature needs to take steps to ensure that every one of these families stays protected from companies that might seek to capitalize on the ambiguities present in new health care laws. Senate Bill 1313 would make misrepresenting ACA a crime, ensuring that all health plan documentation and advertisements are clearly worded and well-translated.
