Goal: Reverse decision to allow husbands to sue doctors to prevent wives from having abortions.
A husband can now legally prevent his wife from having particular types of abortions by suing a doctor in Arkansas. This new law does not make exceptions for cases of spousal abuse or rape.
The law is called the Arkansas Unborn Child Protection from Dismemberment Abortion Act. It prohibits the most common form of second-trimester abortions, and contains a clause allowing the husband of a woman getting an abortion to sue the doctor to stop the procedure, as long as he is the father of the fetus. Since cases of rape or incest are not exempt, it would be possible for a woman’s rapist to file suit to stop her abortion.
This law tramples over women’s rights and completely disregards the well-being of the mother, not just in cases where a rape victim may be forced by her rapist to carry the pregnancy to term, but in all cases where the husband now automatically has the upper hand when it comes to his wife’s body. Dear Governor Hutchinson,
The Arkansas Unborn Child Protection from Dismemberment Abortion Act is an unconstitutional violation of women’s rights. It disregards the well-being of pregnant women who deserve control of their bodies, and whose decisions regarding their bodies should not be trumped by the actions of their husbands.
The clause allowing husbands to sue doctors to stop their wives having abortions is especially troubling, not least because it makes no exception for cases of spousal abuse, incest, or rape. This law would make it possible for a rapist to legally force his victim to carry her pregnancy to term, with no regard for the woman. I urge you to reconsider and reject this law, and respect the rights of the women in your state.
