Remove Judge Who Told Rape Victim “Sex and Pain Sometimes Go Together”

Goal: Remove Justice Robin Camp from the bench for inappropriate and harmful comments about rape.

A judge used all manner of victim-blaming logic and let the man charged with rape walk with a mere warning while presiding over a sexual assault trial. Court transcripts show that Justice Robin Camp told the victim: “Sex and pain sometimes go together. That’s not necessarily a bad thing. Sex is very often a challenge.”

He now must make a public defense for his job as the Canadian Judicial Council is set to determine whether his handling of the trial warrants his removal from the bench. Four law professors filed a complaint against Camp for misinterpreting sexual assault laws during a trial that was threaded through with antiquated stereotypes and myths regarding sexual violence.

At the judge’s hearing, the victim told the court that Judge Camp made her feel like she was to blame for the assault and left her with suicidal thoughts after letting her alleged aggressor walk free. She testified that the judge wondered why she “couldn’t just keep [her] knees together,” and that he made her hate herself and feel “like some kind of slut.”

As if this wasn’t enough, during the assault trial Camp illegally admitted testimony about the victim’s prior sexual history and illustrated his lack of understanding of the crime with the intimation that “a woman cannot be raped against her will.” This is not justice, and these actions show that Camp is not fit to be a judge. Encourage the Canadian Judicial Council to follow through and remove Judge Camp from the bench.

Dear Right Honourable Justice McLachlin,

The choice of the Canadian Judicial Council to question whether Justice Robin Camp is fit to be a judge must be applauded, and after the inappropriate and harmful comments he made during a sexual assault trial, the decision should be to remove him from the bench. His complete misunderstanding of sexual assault laws are illustrated by his victim-blaming tactics and his illegal admittance of testimony about the victim’s sexual history during the trial. These actions should not be allowed to stand.

His actions have also had long-lasting effects on the plaintiff of the case he oversaw. She expressed that she feels like a slut, like the attack was her fault, and has been plagued with suicidal thoughts since the defendant was let off with a warning. Justice Camp’s intimations that “a woman cannot be raped against her will,” and that the rape victim should have “kept her knees together,” are a miscarriage of justice and cannot be allowed to continue. I urge you to rule in favor of Justice Camp’s dismissal.
