Release 14-Year-Old Boy Allegedly Tortured In Custody

Target: Nabil Sadek, Public Prosecutor

Goal: Drop charges against 14-year-old Aser Mohamed based on confessions made after allegedly being tortured.

Agents with the Egyptian National Security Agency detained 14-year-old Aser Mohamed during an early morning raid on his family’s home. The agents neither had an arrest or a search warrant, and claimed to be taking him away for a brief questioning. They refused to tell Aser’s family where they were taking him, and he disappeared for 34 days. When he reappeared, he was facing a number of charges based on confessions he claims he gave after being tortured. 14-year-old Aser Mohamed now faces 15 years of imprisonment.

Further compounding the violations of his human rights, prosecutors have ordered that Aser be remanded into pre-trial detention, in direct contravention of an Egyptian law that makes pre-trial detention illegal for those under the age of 15. When he tried to report the alleged torture, the prosecutor did not open any investigation and reportedly threatened to send Aser back into National Security Agency custody if he attempted to recant any of his confessions. He is being held with 12 other detainees in a 4-by-6 meter cell, and has been denied any contact with his family. Sign our petition and demand that Aser be freed, the charges against him dropped, and his allegations of torture investigated.

Dear Prosecutor Sadek,

As you know, according to Egyptian law, pre-trial detention is illegal for people under the age of 15. Therefore, the continued detention of Aser Mohamed, 14, is illegitimate, and he must be released immediately. In the meantime, I urge you to allow him access to legal representation as well as his family. Given the serious nature of the charges laid against him, preventing him accessing his lawyer may well lead to a grievous miscarriage of justice.

Furthermore, I was disturbed to hear allegations that Aser was tortured in NSA custody, and that his confessions are a product of that torture. It was alarming to hear that, while your office was made aware of these allegations, there has been no investigation opened in this matter. Neglecting to investigate these allegations compromises Aser’s right to a fair trial and due process, I urge you to investigate his claims and bring the parties responsible to justice.
