Target: L. Dennis Michael, Mayor of Rancho Cucamonga, California
Goal: Publicly criticize barber for his refusal to cut the hair of a transgender man based on Biblical reasons.
Richard Hernandez reportedly refused to cut Kendall Oliver’s hair on the grounds that the bible forbids cutting women’s hair. Although assigned female at birth, Kendall Oliver identifies as male and was seeking a male-style haircut. He alleges that when he tried to explain this to Hernandez, he was told that did not matter; that the barber does not cut any type of women’s hair.
Hernandez argues that religious freedom protects his right to refuse this haircut, while both California and national laws protect Kendall’s rights and prohibit discrimination on the basis of gender. As a fair compromise to protect everyone’s rights, Hernandez could have asked one of his employees to cut Kendall’s hair or contacted another barber to obtain an appointment for Kendall.
Demand Richard Hernandez’s actions are publicly criticized to help him see alternative, equitable solutions.
Dear Mayor Michael,
A battle of freedoms is taking place in your community. Local barber Richard Hernandez refused to cut Kendall Oliver’s hair because Kendall was assigned female at birth. Surprisingly, his transgender status was not the reason for Hernandez’s refusal. Instead, Kendall claims Hernandez refused to do the haircut because the bible prohibits cutting women’s hair.
Religious freedom is valued in this country, but so is gender freedom. Hernandez could have offered a compromise, but did not. We demand Hernandez’s actions are publicly criticized and that he is trained in providing other options for trans people.
