Justice for Woman Who Had Miscarriage During False Arrest

Goal: Seek justice for woman who suffered a miscarriage, allegedly caused by police misconduct, during a false arrest.

A pregnant woman in New York City has suffered a miscarriage after she was allegedly thrown to the ground and beaten by police. It is unknown why the police were at the home of Emelda Fitzroy, although she was later arrested for assault, resisting arrest and obstructing governmental administration. When they arrived, Fitzroy informed them that she was pregnant, and the four officers allegedly responded by throwing her to the ground and stomping on her stomach.

She has filed a suit with the city, which claims she was arrested “without any legal justification.” Her suit claims that the NYPD is guilty of unlawful search and seizure, common law assault and battery, false arrest and use of excessive force. She was held for 26 hours and then released with the charges against her dropped. In this time, she had a miscarriage as a direct result of the injuries she allegedly suffered during the arrest.

This is not the first time in recent years that NYPD officers have been responsible for a miscarriage. It is a gross overreach by officers who place their authority too highly. Demand that the officers get punished, if found guilty, and that Fitzroy gets the maximum amount in her suit.


Dear Commissioner Bratton,

We are writing to demand that justice is served in regards to Emelda Fitzroy, a woman who suffered a miscarriage at the hands of four allegedly violent officers who wrongfully arrested her. When four officers came to arrest Fitzroy on a number of assault charges, she informed them that she was pregnant, and they allegedly responded by violently kicking her stomach. She later suffered a miscarriage.

If these officers are found guilty of this crime, then they knowingly harmed her unborn child. They did it on purpose, and it is a disgusting and disgraceful act. You do not want that representing the NYPD. This is not the first time the NYPD has done this in recent years. People may not believe that New York officers are there to serve and protect when they are allegedly throwing people to the ground and killing their unborn children.

Fitzroy has opened a case against the NYPD, and we demand that she get the full compensation for her tragic loss and physical injuries if these officers are found guilty. We also demand that the four officers accused of this crime, who showed an egregious overreach and violent use of force, are punished accordingly if found guilty. Please bring justice for Emelda Fitzroy.
