Target: Attorney Mark Ober, Hillsborough County, Florida State Attorney
Goal: Investigate and punish landlord for evicting couple upon receipt of service dog.
A Tampa, Fla. landlord is accused of evicting a couple after the woman received a service dog to help cope with Post-Traumatic Stress Disorder (PTSD). The couple claims that their landlord, Richard Bavota, told them the dog was a violation of their lease.
Pam Clark and her fiancé James further allege that they’d been paying their rent on time, but after she got her service dog, Bavota stopped accepting their payments. They allege that he then used this to evict them for lack of rent payment.
According to Pam, the stress of dealing with fighting the eviction, despite her legally protected right to a service animal, was too much so the couple chose to move instead. Pam explains that her dog, Ammo, alerts her to chemical and medical changes within her body before she’s aware of them so that she can prevent the more severe PTSD symptoms.
Demand these allegations are investigated, and if true, that Richard Bavota is punished accordingly.
Dear Attorney Ober,
The Americans with Disabilities Act (ADA) protects the right of disabled people to have a service animal where animals are not otherwise permitted. A Tampa couple accuses their former landlord of violating this law. Pam Clark suffers from severe PTSD and was matched with Ammo to manage these symptoms. Pam explains that Ammo is able to alert her of chemical changes in her body prior to her being aware of them so that she can avert a more extreme reaction.
Pam and her fiancé allege that when Pam received Ammo, the landlord sent them a text that the dog was a violation of the lease. They further claim that when Pam refused to give up her right to the service dog, Richard Bavota ceased accepting rent payments and then used lack of payment to begin eviction proceedings.
We demand these accusations be thoroughly investigated, and if true, that Bavota be punished to the fullest extent possible.
