Trans-Gender Violence Must be Included in Illinois Hate Crime Law

Target: Illinois Governor Pat Quinn

Goal: Protect trans-gender persons by adding it to Illinois’ hate crime law.

A new amendment to the Illinois Criminal Code of 1961 including gender identity has been introduced. The bill was authored by Illinois activists and members of the Civil Rights Agenda and then introduced by Rep. Kelly M. Cassidy. The bill also includes protection for people who experience violence based on their military status or immigration status.

This amendment was made possible through the efforts of LGBTQA activists and would be a significant step for Illinois. Unfortunately, many transgender individuals endure violence stemming from hate and discrimination. The National Coalition of Anti-Violence Programs reports that transgender women make up almost half of LGBTQA murder victims. Many other violent crimes go unreported because victims fear harassment or judgment from law enforcement officials. The same study also found that of those who did report the event, 60 percent said authorities were “indifferent, abusive, or deterrent.”

Currently, there is no protection regarding gender identity in the Illinois Hate Crimes Act. But these are clearly identity-based hate crimes as well, and should be treated as such in the legal system. The amendment would make our current legislation much more inclusive and hopefully lead to a change in the way hate crimes are handled in Illinois.

The new amendment adding gender identity to the Illinois Hate Crimes Act would be a profound step in providing justice for the transgender community.  Anti-LGBTQ hate crimes are extremely prevalent in our society, and transgender individuals deserve the same protection under the law. A devastating amount of these crimes go unreported because authorities fail to respect victims because of their identities.

It is up to lawmakers to ensure that everyone is represented, and this piece of legislation would make the Illinois Hate Crimes Act much more inclusive. Everyone deserves protection and respect. Please support H.B. 4725 in your decision-making.

    Exactly, why has this bill not pass in illinois? quinn supports same sex marriage, but yet he will not sign this bill that includes the protection of Transgender and Gay community member from hate crimes.
