Success: Young Man Needlessly Branded Sex Offender to Be Resentenced

Goal: Praise possible resentencing and continue to fight for justice.

A young man who was needlessly branded a sex offender for having consensual sex with a young woman who lied about her age has a shot at being resentenced thanks to the hard work of his lawyer and activists, including those on Force Change who signed a recent petition in his defense. The young man, Zach Anderson, was on the verge of having his life ruined by a victimless crime but now there is a glimmer of hope and those responsible deserve to be commended.

For some reason, the moment that sex enters a conversation, most people become uncomfortable. Whether societal norms or an over-religious populace are to blame is irrelevant, because either way, this leads to biased discussions about sex and crime and whether or not something truly demands punishment. In this case, Zach Anderson met up with a young woman who claimed to be older than she was and had consensual sex with her. There is no victim here, the police were called because the girl’s mother couldn’t find her, not to report statutory rape. The girl’s mother has said that she doesn’t want Zach to be punished and doesn’t believe he is a sex offender.

Thankfully, the judge who presided over this case the first time has said that because part of a plea bargain was not upheld, Zach is eligible for resentencing. There is no word on when the resentencing will happen, and it will undoubtedly require more work from Zach’s lawyer and other activists, but this is a huge success that may help save this young man from a lifetime of scorn and shame. Dear Mr. Grabel,

I am writing to express my profoundest admiration for you and your defense of Zach Anderson. He is clearly not a sex offender in any definition of the word and he had no intention to commit any crime whatsoever. It’s difficult to understand how anyone could take a look at the facts of this case and view him that way, but that’s what happens when an overly puritanical populace has to try attempt impartiality.

This is a case of older people being scared of younger people’s sexuality that is as old as time. This same thing plays itself out over and over again and I thank you for attempting to put a stop to it. I understand that sex offender registries and statutory rape laws have their place, but that place is nowhere near Zach Anderson. Please continue to fight on his behalf until he is given the justice that he truly deserves.

  1. Zach was far, far more sinned against than sinning. You cannot judge a teenager the same way you judge an adult. We need to ditch “one size fits all” laws designed to reign in sex offenders and make allowances for juveniles. Draconian laws harm innocent people and weaken our society.
