Close Loophole That Allowed Charleston Shooter to Buy a Gun

Goal: Close the gun background check loophole that allowed the Charleston killer to buy a firearm.

The Charleston shooter who murdered nine black people in a church was able to buy a gun despite being flagged during the background check. During the check, he was flagged by the FBI for further investigation. However, because of a loophole in firearm background check laws, the gun was sold to him anyway even though the process was incomplete.

The whole point of background checks is to keep dangerous people from buying extremely deadly weapons. The racist, white supremacist man who slaughtered nine welcoming black church-goers never should have been allowed to purchase a gun due to his violent past. Because background check laws in the U.S. are so weak due to constant pressure by the NRA, the killer was able to obtain the weapon he used to carry out the horrific act that shocked the nation.

If someone can be flagged by the FBI and still somehow get a gun in three days, clearly there is a massive and unacceptable loophole in our background check laws. Sign this petition to demand that our lawmakers immediately move to close this loophole before another hateful and violent individual is able to purchase a firearm and kill more innocent people.


Dear House Majority Leader McCarthy,

It’s been revealed that the reason the Charleston shooter, Dylan Roof, was able to obtain the firearm he used to kill nine people in a church is because of a loophole in our background check laws. During the three-day background check process, Roof’s file was flagged by the FBI for further investigation. But because of this loophole, the seller was legally allowed to give him the gun anyway with the background check left incomplete.

This is ridiculous. If a person is flagged by the FBI during a firearm purchase background check, they should in no circumstances be allowed to obtain the gun until the investigation is complete. Had the law worked as it was intended to, nine innocent people could still be alive today. This is clearly something that needs to be addressed immediately, especially as mass shootings become increasingly common in the U.S.

Even if Roof could have obtained a firearm another way, such a huge flaw in our background check laws is a disgrace. The vast majority of Americans are in favor of background checks, and we expect them to be basically functional. We demand that you immediately act to close this loophole before more innocent people die at the hands of violent and bigoted killers.

  1. No need to change the process. The problem was one government entity didn’t do its job so the data needed to prevent the sale wasn’t in the FBI database.
