Criminalize Marital Rape

Goal: Include marital rape as a crime under Indian law.

The Indian government has recently decided that it will not criminalize marital rape. This decision comes under the UN Committee on Elimination of Discrimination against Women recommending that India criminalize rape within marriage. The government has asserted that rape within marriage cannot be applied in their country, since marriage is sacred in their society.

According to the United Nations Population Fund, 75 percent of married women in India are victims to marital rape. By the definition of marital rape, this means that three out of four married Indian women are forced to have sex with their spouse under physical threat, physical violence, or at times when the woman is not able to give consent.

Marital rape is not criminalized in India because the government believes that it would weaken their traditional values, and that marriage in itself assumes consent. Because of these reasons, the law still stands and there are no current proposals for an amendment to the law. However, there has been a strong push from thousands of Indian citizens to criminalize marital rape and severely punish any guilty rapists.

There are currently 620 million females in India, which means hundreds of millions of women are raped by their husbands each year. The tradition is tied to the sacredness of marriage, without an emphasis on individual rights. India is a beautiful country with a rich tradition. Marriage is a traditional and highly valued aspect of the culture, and remains so to this day. However, millions of married women are raped each year in India.

Seventy-five percent of married women are raped by their husbands, and there are no repercussions for those who commit the crime. This number also does not include those who have stayed silent during their trauma. Please support this petition to criminalize marital rape in India, bring justice to all raped women, and possibly prevent millions of rapes in the future.
