Goal: Demand justice for raped three-year-old and ensure the rapist receives the mandatory sentence length.
A three-year-old toddler was sodomized by Kevin Jonas Rojano-Nieto, who was only sentenced to 10 years in prison even though the minimum length is supposed to be 25 years to life in prison. The presiding judge was Judge M. Marc Kelley of the Orange County Superior Court in California. Although a jury found Rojano-Nieto, 20, guilty of having sexual intercourse with a child 10 years or younger and committing a lewd act with a minor under 14, Judge Kelley stated that he felt that the minimum sentence of 25 years to life in prison would be “cruel and unusual punishment.”
The assault happened when the three-year-old girl wandered into Rojano-Nieto’s garage, where he was playing video games. He then became sexually aroused and assaulted her. However, Judge Kelley did not see this case as a situation in which a “pedophilic child predator preys on an innocent child” even though there is no question that it was. The judge went on to say that there was “no violence or callous disregard for [the victim’s] well-being.” As if the judge’s logic weren’t shocking enough, he continues to justify the rapist’s actions and even blames an innocent child, stating, “Mr. Rojano did not seek out or stalk [the victim]. He was playing video games and she wandered into his garage.” Apparently, according to Judge Kelley, Rojano-Nieto did not “appear to consciously intend to harm” the child when he was sexually assaulting her.
The rapist should have been sentenced to the maximum sentence for sexually assaulting a minor, but Judge Kelley decided to excuse his actions. Please sign this petition to demand the US District Attorney’s Office in Santa Ana to appeal this case and ensure that Rojano-Neito gets the mandatory sentence for raping a helpless child.

Kevin Jonas Rojano-Nieto was convicted of raping a three-year-old child and only sentenced to 10 years in prison because the presiding judge, M. Marc Kelley, felt that anything longer than that was cruel and unusual punishment. This is 15 years short of the mandatory sentence for this despicable crime. I do not understand how a minimum of 25 years in prison is cruel and unusual punishment for a man who knowingly assaulted an innocent child and traumatized her for life.
Judge Kelley said there was no violence or callous disregard for the victim’s well-being, which is disgusting because that is exactly what rape is. The child suffered tissue injuries in her rectum as a result of the assault. How can Judge Kelley excuse Rojano-Nieto for inflicting psychological and physical pain on a toddler?
Giving the rapist a mere 10-year sentence is a slap in the face to not only the poor child but to all victims of rape. Judge Kelley has no right to justify Rojano-Nieto’s intentions. His statements are disgusting. I am urging you to appeal the victim’s case to make sure that the rapist gets the mandatory sentence he deserves.
