Target: U.S. District Judge Joseph Bataillon
Goal: Praise judge for ruling Nebraska’s ban on same-sex marriage unconstitutional.
Federal judge Joseph Bataillon recently ruled that Nebraska’s ban on same-sex marriage was unconstitutional after seven same-sex couples brought the case to the state, calling it “unabashedly gender-specific infringement of the equal rights of its citizens.”
Judge Bataillon issued a preliminary injunction that would take effect shortly and allow same-sex couples to marry within the state without causing administrative turmoil. Nebraska officials were quick to appeal Judge Bataillon’s decision to the 8th Circuit U.S. Court of Appeals.
Governor Pete Ricketts said in a statement, “the definition of marriage is an issue for the people of Nebraska, and an activist judge should not substitute his personal political preferences for the will of the people.” If Judge Bataillon is inserting his personal political preferences into this issue, than it seems that Governor Pete Ricketts is doing the same thing by making this statement and appealing the decision.
Nebraska officials had asked the judge to put a hold on the challenge and wait for the U.S. Supreme Court to decide whether states can ban gay marriage. They argued that the Supreme Court will raise the same questions as the state. This is simply a tactic employed only because they are on the losing side of a human rights argument. Other states are having no trouble allowing same-sex couples to marry and the only reason for asking to hold the decision is because it is the only thing they can do in opposition of the decision for now.
It’s truly sad that we still have to fight for equal rights for same-sex couples. All people deserve to have the same basic rights as anyone else, and this includes the decision to marry those of the opposite sex. Thank you for your recent ruling that the ban on same-sex marriage in Nebraska is unconstitutional. The decision to block the same-sex marriage ban now puts Nebraska in the majority of states that have allowed gay couples access to this basic human right.
It is sad to hear that that Nebraska officials, including Governor Pete Ricketts, are already appealing this decision, but that is to be expected from those who are adamant in denying these freedoms to all citizens. Thank you for accepting this ignorant criticism and supporting equal rights for everyone in Nebraska.
Same-sex couples deserve the rights and responsibilities that marriage allows, and your progressive stance helps Nebraska move forward along with other states that allow same-sex marriage. Thank you for doing what is right and ruling the same-sex marriage ban to be unconstitutional.
