Goal: Renew the case against the cop who killed a surrendering teen

The explosive case of a cop killing an unarmed black teenager in Ferguson, Missouri is still sending shock waves throughout a community that refuses to be the victims of targeted racial violence. It was recently revealed that the city prosecutor for the grand jury case against Officer Darren Wilson presented evidence in favor of Wilson that he knew to be false. Despite the fact that Ferguson prosecutor Bob McCulloch was aware that a witness he brought in was not even at the scene of the shooting, she was allowed to testify for several hours over two days to the grand jury. This casts serious doubt over the legitimacy of the case and could be grounds for a renewal of the entire process with a new prosecutor.

According to the Missouri Rules of Professional Conduct, lawyers are not allowed to offer evidence that they know to be false in a court case. Because of this and other evidence that suggests McCulloch purposefully did not try to get an indictment, despite the fact that this is his job, the Presiding Judge of the 21st Circuit Maura McShane could decide to restart the case against Darren Wilson on the basis of a demonstrated bias.

By signing this petition, you’ll urge Judge McShane to appoint a new, independent prosecutor to conduct a renewed grand jury case about the shooting of Michael Brown by Officer Darren Wilson. As more details emerge about the case, it’s becoming increasingly clear that Bob McCulloch had a significant bias in favor of Wilson and did not want him to be indicted. McCulloch did not do his job, and it’s time to find someone who will.


Dear Judge McShane,

Ferguson prosecutor Bob McCulloch recently admitted that he was aware of the fact that a key witness who testified in favor of Officer Darren Wilson in the case about the killing of Michael Brown was not even in the area when the shooting happened. This is a serious ethics breach under the Missouri Rules of Professional Conduct and is clearly grounds for restarting the entire grand jury case against Wilson.

Prosecutors are supposed to fight for an indictment, and it’s against the rules to present evidence that the prosecutor knows to be false. The fact that McCulloch had this witness who claimed to see Michael Brown charge at Darren Wilson testify for several hours even though he knew she was lying shows a serious conflict of interest or bias. Please appoint a new prosecutor for the case and have the process restarted so that it can play out in a manner that’s fair to Brown’s family and community.

This latest confession by McCulloch is just another item on a long list of evidence that he was trying to stop an indictment from happening. You have the power to make things right after a serious breach of justice that has sent the message to millions of black Americans that the justice system of the U.S. will not protect them and has only caused even greater tension between people of color and police forces. Please do what you can to ensure that justice is done.
