Goal: Halt the practice of forcing new hires at Jimmy John’s to sign a contract that forbids them from working at other sandwich shops
Sub sandwich restaurant Jimmy John’s may be investigated by the U.S. Labor Department due to its practice of requiring new hires to sign a non-compete contract that says they cannot work at another sandwich shop for two years after leaving their position at Jimmy John’s. This means that should any of its employees look for better work, they cannot take a job at any restaurant that gets 10 percent or more of its revenue from sandwich sales and sits within a three-mile radius from a Jimmy John’s location. If they break the non-compete, they could face legal action and lose their new job.
Non-competes have traditionally been used in the technology industry to keep people from taking innovative strategies and guarded information over to competitors, which could substantially hurt business. It’s absolutely ridiculous to apply such a contract to a job where all you do is make sandwiches. It’s clearly meant to intimidate workers into staying with Jimmy John’s, no matter how badly the company treats them. Seeing as Jimmy John’s was recently under fire for stealing wages, it makes this intimidation tactic even more sinister.
By signing this petition, you’ll share you outrage at Jimmy John’s continuing manipulation and mistreatment of its workers. If an employee wants to work at a different restaurant that treats them better, they should be able to do so without fear. The way to keep employees is to treat them right, not by threatening them with lawsuits. Help put an end to corporate bullying by signing the petition below.
Dear Mr. Liautaud,
It has recently come to public attention that you’ve been requiring all of your newly hired employees to sign non-compete contracts before beginning work. These contracts prohibit them from working anywhere that sells a substantial amount of sandwiches within a three-mile radius of a Jimmy John’s restaurant location for two years after leaving your company.
This policy is unacceptable. It’s clear that since you have been guilty of wage theft in the past and you don’t seem to have pursued any cases of broken non-competes, these contracts are simply made to intimidate employees into remaining with your company. This means that you can more effectively threaten them with firing should they attempt to protest or unionize, and you can get away with more abuse since a worker who can’t go to another sandwich shop will put up with more bad treatment.
I will not sit back and let you get away with bullying your workers while you make billions off of their labor. You know as well as I do that your employees are not learning any kind of essential trade secrets while working for you, and it’s absolutely reprehensible to force them to agree not to use the experience they gain with your company to look for better work that can help improve their quality of life. Your workers are people, not tools for you to manipulate to your liking. End the practice of using non-competes immediately.
