Repeal Law Allowing Government to Revoke Citizenship

Goal: Repeal Kuwaiti law that allows government to revoke citizenship

The government of Kuwait should immediately restore the citizenship of five government critics that were revoked as part of a crackdown on activists and reformers. The practice of revoking citizenship is illegal under international law and should not be used by the Kuwaiti authorities. The government claims that the activists were attempting to undermine, ‘the country’s security and stability’ and that they were, ‘bringing harm to its institutions’. Actions taken by the government against these five men should be immediately reversed so that they will not be stateless.

Kuwait is seemingly doing all that it can to lose its title as the most rights-respecting Gulf nation. Kuwait’s law of nationality allows the government to revoke citizenship and deport them. Citizens may be subjected to this law if they commit fraud or a crime within 15 years of gaining citizenship. Citizenship can also be revoked if it is proven that the individual has undermined the country or jeopardized state security. These are charges that can be drummed up quickly and without much evidence as is seen in this latest case.

The Kuwaiti law is in conflict with the International Covenant on Civil and Political Rights to which Kuwait is a party. The Covenant states that, ‘no one shall be arbitrarily deprived of the right to enter his own country’. Continuing this practice should bring sanctions from the international community and the threat of legal action against individual government leaders. Dear Prime Minister Jaber Al-Mubarak Al-Hamad Al-Sabah,

The practice of revoking citizenship for critics of the government is a practice that should be immediately discontinued in Kuwait. Kuwait’s law of nationality is a violation of numerous international human rights laws and will bring sanctions from the international community against your country. I ask that you do what is best and immediately order that the revoking of citizenships be halted.

Claims made by your government that activists with stripped citizenships were attempting to undermine the country’s security can not be supported by fact. It seems to be that this is a tool to control political opposition within your country. I ask that you do more to uphold your reputation as the most rights-respecting Gulf nation.
