Goal: End workplace discrimination on the basis of sexual orientation and gender identity
Many Americans falsely believe that employers are not legally allowed to discriminate against potential or current employees on the basis of their sexual orientation or gender identity. Unfortunately, they are wrong. Although an impending executive order will soon make this unethical and antiquated practice illegal for federal contractors, many states still do not have protections for gay employees in place, leaving them vulnerable in the workplace. Urge the House to pass a bill that will ban all employers from discriminating against LGBT workers.
Only 21 states currently have explicit laws barring firing employees on the basis of sexual orientation, and only 18 of these extend the protection to transgender workers. In those states, the number of complaints of discrimination on the basis of sexual orientation are about equal to those filed on the basis of sex. Research suggests that transgender people are even more susceptible to workplace discrimination and harassment, often feeling as though they need to hide their identity to avoid mistreatment.
President Obama’s proposed executive order, while a definite step in the right direction, is limited in scope. Unlike the Employment Non-Discrimination Act of 2013, it does not extend to all employers across the country, but only to federal contractors. The anti-discrimination legislation already passed the Senate last year with bipartisan support, but has been languishing in the House ever since.
Demand that the House pass this important measure, which has been under consideration since the bill’s first iteration in 1974, and end employment discrimination for millions of LGBT workers nationwide.
Dear Rep. Boehner,
Millions of hard-working Americans across the country are not protected from employment discrimination under federal law. We demand that you pass the Employment Non-Discrimination Act of 2013 to ensure that workers are not discriminated against on the basis of their sexual orientation or gender identity.
In states that do not have laws explicitly prohibiting such abuses, many LGBT employees may be subject to unjust termination, mistreatment, or harassment if their personal lives are revealed. Like sex, race, or ethnicity, sexual orientation and gender identity have no bearing on an employee’s job performance or competencies, and should not be a consideration when deciding who to hire or who to let go.
Although President Obama’s upcoming executive order will prohibit discrimination among federal contractors, other employers will legally continue to engage in biased employment practices. End this unjust treatment by passing the Employment Non-Discrimination Act, and guarantee equal opportunities for all Americans.
