Five teenagers and two nonprofits have filed a lawsuit against the federal government for failing to protect today’s youth and future generations from the impacts of climate change. According to their lawyer, Julia Olson, this failure amounts to a violation of their constitutional rights. In their suit Kids vs. Global Warming and WildEarth Guardians cite the public trust doctrine which requires that certain natural resources be protected and maintained for public use.
The lawsuit was filed against six federal agencies: the Environmental Protection Agency (EPA) and the Departments of the Interior, Agriculture, Commerce, Energy, and Defense. The complaint reads, in part, that “Unless the government acts immediately to rapidly reduce carbon emissions…youth will face irrevocable harm: the collapse of natural resource systems and a largely uninhabitable nation.” Although the EPA already has a climate action plan in place the plaintiffs maintain that it is not nearly strong enough or timely enough to ensure a livable future.
The case has already gained support from more than 30 environmental and constitution professors, as well as from retired NASA scientist James Hanson. The active opposition of the National Association of Manufacturers and several fossil fuel lobbying organizations is evidence of the campaign’s potential to significantly impact legislation. Thank you for standing up for the right of all of us to live on a planet that supports life as we know it. The innovative approach of Kids vs. Global Warming and WildEarth Guardians–to sue their government for failing to take action at the level needed to prevent irreversible damage–is both clever and inspiring.
Despite the outcry of international scientists, activists and citizens any action to address global warming has been slow in coming. Climate change is the great challenge of our generation and it will take the dedication of people like you, and the youth and organizations you represent, to pressure elected officials into finally enacting solutions.
