Commend Senator for Strengthening Animal Neglect Laws

Goal: Commend senator for introducing legislation to improve animal neglect laws

Nebraska legislators recently passed a bill that will enable judges to impose stricter criminal penalties on individuals convicted of animal neglect. The previous penalties were too lenient to dissuade perpetrators of animal neglect from repeating their unlawful crimes. Senator Ernie Chambers needs to be commended for introducing and fighting for legislation that strives to protect animals.

In 2013, Nebraska judge Timothy C. Phillips decried his state’s overly lenient animal cruelty laws when he tried the owner of a puppy mill that he described as an “animal Auschwitz.” Many of the nearly 100 puppies and dogs rescued from this puppy mill reportedly lived in cages coated with urine and fecal matter. Several dogs were malnourished due to neglectful feeding and most bore some kind of injury from lack of care: infected sores, matted hair, uncut nails, and rotten teeth were common. Nebraska’s animal neglect laws at the time only allowed Phillips to punish the puppy mill owner with two years’ probation, during which time she could not “own, possess or raise animals.” Phillips would have liked to have extended that probation for several more years in order to impose a stricter more meaningful punishment.

State Senator Ernie Chambers shared Judge Phillips’s anger, and so he introduced bill LB674 in order to strengthen his state’s animal neglect laws. Bill LB674 makes animal neglect  in Nebraska a Class I misdemeanor, which means a judge can punish an offender with one year in jail, a $1,000 fine, or both; in addition, a judge can prohibit an offender from owning or raising an animal for five years. The Nebraska State Senate passed the bill on a unanimous vote. Hopefully, these stricter punishments will protect more animals by dissuading offenders from again harming animals via neglect.

I believe the previous penalties for animal neglect violations in Nebraska were too lenient to dissuade offenders from repeating their unlawful crimes against animals. Hopefully, the new, stricter laws will help do so.
