Goal: Commend judge for striking down the gay marriage ban in Texas
Despite the recent onslaught of conservative states passing bans on gay marriage and bills that refuse service to the LBGT community, good news has arisen in at least one place. A San Antonio based federal judge, Orlando Garcia, has struck down the gay marriage ban in Texas. Commend the judge for standing up for human rights and allowing Texas citizens to marry whomever they love.
The move sets the stage for gay and lesbian couples to get married, but while the ban has been struck down, these couples can’t get married yet. Garcia’s decision is pending on appeal and Texas Attorney General Greg Abbott states that his office will be appealing the ruling.
“The U.S. Supreme Court has ruled over and over again that states have the authority to define and regulate marriage,” said Abbott, who is running for governor. “The Texas Constitution defines marriage as between one man and one woman.”
Garcia said that he struck down the ban because it had no “rational relation to a legitimate government purpose.” Garcia believes that all individuals should be treated equally under the law and that a Supreme Court ruling “prohibits passing legislation born out of animosity against homosexuals.” Similar rulings made by federal judges have taken placed in Utah, Virginia, Oklahoma, and Kentucky. Despite this, there are still states trying to bypass the Supreme Courts’ ruling on gay marriage by exercising their state sovereignty. These violations to human rights need to stop, and luckily our federal judges are fighting for this. Commend Judge Orlando Garcia for striking down this ban.

You have given many people in the LGBT community and their supporters reason to celebrate and hope. With your recent ruling on Texas’ gay marriage ban, you have set the stage for gays and lesbians to wed in the state. I am so grateful that you are upholding the Constitution, and acknowledging that a ban such as this is a violation of human rights.
I wish to commend and thank you for your decision. I know that the fight is not over; Texas Attorney General Greg Abbott intends to appeal your ruling. Please continue to do all you can for gays and lesbians in Texas and rest assured that you will have their full support.
